Terms of Service
These terms govern your use of bSafe Your Guardian. Please read them — the safety notice in particular — before you rely on the service.
bSafe Your Guardian is a tool to help you get assistance. It is not a replacement for the emergency services. It depends on your device, its battery, mobile or internet coverage, GPS, third-party networks and, where enabled, a monitoring partner — so we cannot and do not guarantee that an alert will always be sent, received or acted upon, or that help will arrive in time. In an emergency, always call 999, 112 or your local emergency number directly whenever you are able to. Keep your device charged and in coverage, and test the app so you know how it works.
1. Agreement to these terms
These terms are between you and bSafe Technology UK Ltd, a company registered in Scotland (company number SC872693) ("bSafe", "we", "us"). By creating an account or using bSafe Your Guardian (the "service"), you agree to these terms. If you do not agree, please do not use the service.
2. Who can use the service
You must be at least 16 to hold your own account. Our family features let a parent or guardian add someone younger to a family plan; if you do, you are responsible for that person's use and you confirm you are entitled to set it up on their behalf.
3. What the service does
bSafe Your Guardian is a safety platform. Depending on the plan and features you enable, it can raise an SOS by button, spoken codeword, fake call or fall detection; share your live location, audio and video; run presence, journey and check-in monitoring; escalate to your nominated contacts, to an accredited monitoring centre and to the emergency services; and, for organisations, provide an operator console and records. Features vary by plan, device and region.
4. Your account
Keep your account details accurate and up to date, and keep your password secure. You are responsible for activity under your account. Tell us promptly at support@bsafeworld.com if you think it has been compromised.
5. Acceptable use
- Use the service lawfully and only for legitimate safety purposes.
- Do not raise deliberately false or hoax alarms. Doing so may result in charges, suspension, and referral to the authorities.
- Only add another person's contact details, or monitor another person, where you are entitled to do so and, where required, have their consent.
- Do not misuse, interfere with, copy or attempt to disrupt the service, and respect others' privacy when using its audio and video features.
6. Emergency contacts and third parties
When you add emergency contacts or other people to the service, you confirm you have their permission for us to hold their details and to contact them on your behalf in a safety situation.
7. Organisation and workforce accounts
Where an organisation provides the service to you, that organisation's own policies and agreement with us also apply, and it administers your account. If there is a conflict, its agreement with us governs the organisation's use.
8. Fees, plans and subscriptions
Some features are paid. Any fees, billing period and renewal terms are those shown for your plan when you subscribe. If you buy through the Apple App Store or Google Play, payment is taken and managed by that store under its terms, and paid subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel a subscription in your app-store account settings.
9. Third-party services
The service relies on third parties — for example mobile networks, mapping, messaging and a monitoring centre. We are not responsible for failures in those services that are outside our reasonable control, though we work only with providers we consider dependable.
10. Our intellectual property
We and our licensors own the bSafe Your Guardian platform, software, brand and content. We grant you a limited, personal, non-transferable licence to use the service in line with these terms. The bSafe name and logo may not be used without our permission.
11. Availability
We work hard to keep the service available and reliable, but we do not guarantee it will be uninterrupted or error-free. We may occasionally suspend it for maintenance, security or reasons beyond our control.
12. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under the law.
Subject to that, and given the safety notice above, we are not liable for loss or damage that we could not reasonably have foreseen, that is not caused by our breach, or that arises from your device, connectivity, third-party networks or your failure to follow reasonable guidance. To the extent permitted by law, we are not liable for indirect or consequential loss, and our total liability to you is limited to the greater of the fees you paid us in the 12 months before the claim, or £100.
13. Suspension and termination
You can stop using the service and close your account at any time. We may suspend or end your access if you breach these terms or misuse the service, or where we need to for legal or security reasons. Provisions that by their nature should survive termination will do so.
14. Changes
We may update the service and these terms from time to time. If we make a material change to these terms we will take reasonable steps to let you know, and the "last updated" date above will change. Continuing to use the service means you accept the updated terms.
15. Governing law
These terms and any dispute arising from them are governed by the laws of Scotland, and are subject to the non-exclusive jurisdiction of the Scottish courts.
